Twilight film studio sues Bella Swan jacket designers

Summit Entertainment LLC, the studio behind the Twilight film franchise, is filing suit against BB Dakota, Modcloth and Metropark. BB Dakota created the jacket worn by Kristen Stewart’s Bella Swan character in the Twilight films. The story was initially revealed by The Hollywood Reporter.
   BB Dakota had been advertising a jacket on its website with the following copy: ‘Bella Swann [sic] wears this jacket in Twilight and scores the hottest vampire in high school, and so can you!’
   The jacket itself was created by BB Dakota and bought by Twilight costume designer Wendy Chuck off a Nordstrom rack. It was reissued by BB Dakota this month with the Twilight name.
   Summit’s lawsuit surrounds the tie-in by BB Dakota with the film series BB Dakota sitewithout permission.
   It contends that the jackets are being sold with the Twilight and Bella trade marks without authorization, and alleges copyright infringement over the defendants’ use of the Bella Swan image. It seeks profits from the sales of the allegedly infringing products and treble damages, saying that the infringement is intentional.
   Summit is also seeking an injunction on further sales and the delivery of all jackets to it for destruction.
   By late morning GMT today, the BB Dakota website became inaccessible and showed an error message (above left).
